Saint Louis County becomes smoke-free

"Highlights" of Indoor Clean Air Code

"HIGHLIGHTS" OF INDOOR CLEAN AIR CODE

  • Purpose – It is the purpose of this chapter to promote the health, safety and welfare of the residents of St. Louis County by decreasing exposure to secondhand smoke; and to create smoke-free environments for workers, patrons and visitors to places of employment and all other public places within the County.   • Prohibitions:
    1. It shall be unlawful for any person within an enclosed place of employment to possess lighted or heated smoking materials in any form.
    2. It shall be unlawful to dispose of smoking waste, or to place or maintain a receptacle for smoking waste, in an area in which smoking is prohibited.

  • Responsibilities:
    1. It shall be unlawful for any person having control of a place to knowingly permit any person to violate the provisions of this Code.
    2. A person having control of a place shall clearly and conspicuously post “No Smoking” signs or the international “No Smoking” symbol near all entrances where smoking is prohibited.
    3. An owner, operator, manager, or other person in control of an establishment, facility, or outdoor area may declare that entire establishment, facility, or outdoor area as a nonsmoking place.

  • Exceptions:
    1. Private residences;
    2. Private clubs;
    3. Retail establishments where 60% of the volume of trade is the sale of tobacco;
    4. Permanently designated smoking rooms, not to exceed 20% of the guest rooms;
    5. Cigar bars, provided such entity is in operation on or before the effective date of this Code and provided that smoke does not infiltrate into areas where smoking is prohibited;
    6. Casino gaming areas;
    7. Drinking establishments which are in operation on or before the effective date of this chapter; provided, however, that no smoke infiltrates into areas where smoking is otherwise prohibited, and further provided that each such drinking establishment has posted in a place visible to the public from its exterior a certificate of exemption issued by the Department of Revenue;
    8. Areas designated and posted as smoking areas by the Airport Authority of Lambert St. Louis International Airport.

    * An enclosed area is a space bound by walls (with or without windows) continuous from the floor to the ceiling/roof.

    Examples:
  • Tents
  • Any area with walls continuous from the floor and ceiling/roof

  • * A non-enclosed area is a space not bound by walls (with or without windows) or walls that are not continuous.

    Examples:
  • Canopies
  • Awnings
  • Pavilions
  • Gazebos
  • Any area with no walls, but with a ceiling/roof
  • Any area with walls that are not continuous from the floor and ceiling/roof
